Nulla Osta: What it is? How to bring your family to Italy?

Nulla Osta:

The entry clearance permit (nulla osta) application will be examined by the immigration office in the province in which the person requesting family reunification is resident.

On receipt of the application, the immigration office will call to arrange an interview and arrange an appointment for the submission and stamping of documentation relating to the accommodation and minimum income.

In order to come to Italy through family reunification the following must be proven by your relative in Italy:
Adequate resources to support a family according to the below. These resources can include income from the spouse or family members (numbers from 2015): [Subjected to change]

• One family member: €8,746.14;
• Two family members: €11.661,52;
• Three family members: €14,576.90;
• Four family members: €17,492.28; and
• For one family member with two or more children under the age of 14: €14,576.69

Adequate accommodation for all family members. The accommodation must meet Italian health and hygiene requirements and be fit for habitation, which can only be proved by a certificate signed by the local Italian health authority or a qualified inspector.
More documentation must be provided, most importantly a family reunification nulla osta which your relative in Italy have to apply for.

The immigration office will issue a receipt for the application and documentation submitted and:

If the documentation is incomplete, you will be asked to provide any missing papers. If you do not provide them, your application will be rejected;

If it is found that a marriage or adoption is of convenience and has only taken place in order to allow a foreign national to enter or reside in Italy, the nulla osta will not be issued;

If the documentation is complete, and if all the legal requirements have been met, the nulla osta will be issued within 180 days, after the payment of a revenue stamp of €16.

After the nulla osta has been issued the immigration office will inform the Italian embassy or consulate abroad. You will also be given a letter with the telephone number of the immigration office in order to arrange the interview with the family member necessary to apply for the residence permit. The residence permit must be applied for within 8 days of arrival in Italy.

After 180 days since the application for a nulla osta was received, you can apply for a visa without a nulla osta by presenting a copy of the documents stamped by the immigration office, showing the date on which the full documentation was submitted.

Things to have to apply for Nullaosta:

1. Get a house contract in your name ( there are other ways but this will simplify the work) and get it registered at Agenzia di Entrate( it is important the registered number)
2. Get /Change the residenza after you got the house contract registered from Commune di Genova ( or where you reside)
3. Get the No-objection Certificate from the house owner to bring your wife and stay in the same apartment as you are living.
   1. This can differ from Region to Region, i am posting here for Genova can refer to this site “http://www.prefettura.it/genova/contenuti/43211.htm” can refer to attachment file in the page “Mod.S2Ter.”

4. Get the Sanitaria Allogio certificate from Commune , for Genova I got it from “Controllo Attività Edilizia Via Di Francia 1 - piano 12°.” To get the certificate you need the following documents ready, hence ask the house owner these documents well in advance and he need to get it for you , if it not present. ( This process depends on the “Geometra” the surveyor and it take between 20 to 60 days )
   1. Registered house contract
   2. Planimetria ( it is the plan for the house which shows the dimensions of the house )

4. Once you have done the above points from 1 to 4 , make sure you got the following documents( All the documents are important and must )

1. Carta di Identita
2. Permesso di Soggiorno ( Valid or renewal postal receipt)
3. Pay slip ( Busta paga for the whole year to avoid any doubts )
4. CUD of the previous year
5. Valid Job contract
6. House contract registered
7. Sanitaria Allogio certificate
8. Passport copy of the wife ( better if the spouse name is yours added in it ) but it is not important as the application during the nullaosta does not ask you about your wifes passport number.

6. Once you got the above documents you can go to CGIL, i went to Genova “http://www.liguria.cgil.it/index.php?option=com_content&view=article&id=1280&Itemid=705” INCA CGIL - Diritto di soggiorno per stranieri. They will help you to compile the online application and it is free service.

7. Once done they will inform you to come and collect the receipt of the application after they submit the documents to the Prefettura.
8. Wait for almost 2 months you will receive a postal invitation to come and collect the Nullaost at the address you got the house contract registered.
9. Get the appointment date from the invitation letter and collect Nullaosta from Prefettura

Things to do in India for Family Visa :-

1. Get the following documents Attested from both state and central government
1. Marriage Certificate
2. Birth certificate of Wife
2. Translate the attested certificates as mentioned in point 1. you can approach Italian Chamber of commerce to do it .

3. Legalize the above documents from Italian Embassy/Consulate. This can be done by VFS or Krishnan the agent .
4. Passport with spouse name as the person residing in Italy.
5. Till the point 4 you can do both Italy and India process in parallel ( Infact you can do all the first thee points and the fourth point in parallel to save some time ) , but you need to wait for Nullaosta to proceed further as mentioned in the below points.
6. Get the nullaosta Original from Italy.
7. Get the confirmed ticket to Italy
8. Apply 30 days ( or min 15) in advance for Visa in order to avoid the delay along with the following documents of the spouse residing in Italy to be attached,
9. Permesso di Soggiorno .
10. Carta di Identita
11. Passport of the Husband
12. Nullaosta
13. All translated ,attested and Legalized orginal copies of the birth and marriage certificates.
14. Air ticket ( no need of Insurance).
15. Get the Visa stamped and Enjoy the family life :)
